The Tax Troll
Posted by BrianJohn William Kurowski is "The Tax Troll." He trolls the internet looking for message boards where he posts a boiler plate diatribe about his tax scheme. He claims to be the founder of the "American Constitutional Research Service." I have no problems with people who have ideas different from mine - in fact I love the debate. But, regrettably, Mr. Kurowski prefers to avoid open discussions of his ideas. He will post on a message board and he might even respond once, but then he melts away when the spotlight gets bright. In any event, below you can see a comment I posted on his blog. I saved it because I don't anticipate him leaving it up or opening a meaningful disussion in response, but I've been wrong before.

I am curious. I noticed that you troll the internet in search message boards to post your views. I am impressed by your considerable work. However, I am surprised that your blog has no comments. Does your little taxation concept have any real supporters? Like any tax plan, I’m sure it has detractors. Have your considerable efforts to publicize your blog garnered no feedback, or do you simply delete any comments you don’t agree with?
I am one of the many FairTax supporters that you often target with your troll posts. I am always willing to have a frank and productive discussion regarding the FairTax. Are you willing to do the same in support of your plan?
Also, I did a cursory internet search and couldn't find any evidence that you ever presented your concept to the House Ways and Means Committee. What proof do you have that you actually spoke before them?

I just stumbled across your “Tax Troll” page after getting into it with Mr. Kurowski on the FreeRepublic.com message board and then Googling a search for some more information. I’m writing to tell you that not only is Mr. Kurowski deceptive, he’s actually not very intelligent either. To be specific, he does not understand that what he describes as the “Fair Share Formula” is a “Capitation Tax” under the U.S. Constitution’s Article 1, Sections 2 and 9, and in fact he has pointedly stated that it is not.
Now I don’t want to recapitulate the entire message board discussion but briefly, to clarify that the “Fair Share Formula” is a “Capitation Tax” you can view the following:
1. Constitution’s Article 1, Section 2, Clause 3 — the “Fair Share Formula” as Mr. Kurowski describes it — and read “Representatives and direct taxes shall be apportioned among the several states . . .” to see that this is a “direct tax” according to the Constitution.
2. The Tax Law of 1798 ( http://memory.loc.gov/cgi-bin/ampage?collId=llsl&fileName=001/llsl001.db&recNum=720 ), in which this taxing power was invoked states that it is a “Direct Tax” in its opening paragraph.
3. A Discussion of the Legal History of Tax Laws at Answers.com ( http://www.answers.com/topic/income-tax-in-the-united-states ) makes clear, in its 3rd paragraph, that in Constitutional Law there are only two types of “direct taxes” using the following language — “The courts have generally held that direct taxes are limited to taxes on people (variously called “capitation”, “poll tax” or “head tax”) and property . . . All other taxes are commonly referred to as “indirect taxes . . .”
So since the “Fair Share Formula” is not a property tax, and I cannot believe that Mr. Kurowski will return to argue that it is, it is clearly a “Capitation Tax,” an assertion that can also be supported by the evidence of the “counting of heads,” i.e. “capitation,” used to describe how the tax is to be apportioned among the states.

It appears Tax Troll is being exposed as a poser with an agenda over on Free Republic.
Not only is he loose with his interpretations of law, constitutional history and the FairTax bill, but about his claims to be a witness in Ways & Means (seems he just submitting a paper for the record, as any yahoo can do just by mailing such to the committee) and pretensions to being author of a book written by his departed associate.
The guy is down to threatening posters for exposing the facts about his diatribe and his affiliations found on the internet.
